1. Introduction and Acceptance of Terms
These Terms and Conditions ("Terms") govern the purchase and use of digital sheet music products ("Products") sold through this website, operated by Mirco Candeloro, trading as Metanio ("Seller", "we", "us", "our"), based in Italy. By completing a purchase on this website, you ("Buyer", "Customer", "you") confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must not proceed with any purchase.

3. Nature of Products — Digital Goods
All products sold on this website are digital files (PDF or equivalent formats) delivered electronically. As such:
- Products are delivered instantly upon payment confirmation via download link or direct access.
- No physical product will be shipped.
- The Buyer acknowledges the intangible and non-returnable nature of digital goods prior to purchase.
4. No Refund Policy — EU Waiver of Right of Withdrawal
4.1 General No-Refund Rule
All sales are final. No refunds, exchanges, or credits will be issued under any circumstances once a digital product has been purchased and/or the download link has been made available to the Buyer.
4.2 EU Consumer Right of Withdrawal — Express Waiver
Under EU Directive 2011/83/EU (Consumer Rights Directive), as implemented in Italian law under Legislative Decree No. 206/2005 (Consumer Code), consumers ordinarily have a 14-day right of withdrawal from distance contracts. However, Article 59(l) of the Directive and Article 59 of the Consumer Code expressly exclude the right of withdrawal for:
"the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and his acknowledgment that he thereby loses his right of withdrawal."
By proceeding with a purchase on this website, the Buyer:
Expressly requests the immediate delivery of the digital content;
Acknowledges and agrees that by doing so, they waive their right of withdrawal (right to a 14-day cooling-off period and refund) in full;
Confirms they have been informed of this waiver prior to completing the purchase.
This waiver is recorded at the time of checkout and constitutes a binding agreement.
4.3 No Exceptions
No refund will be issued on grounds including but not limited to:
Change of mind or accidental purchase;
Claimed inability to open, print, or use the file (standard PDF readers are freely available);
Dissatisfaction with the difficulty level or content of the sheet music;
Duplicate purchase;
Technical issues attributable to the Buyer's device, software, or internet connection.
The Seller is not responsible for any third-party software required to access the Products.
5. Intellectual Property and Licence
5.1 Ownership
All sheet music, arrangements, compositions, and related content sold on this website are the exclusive intellectual property of Mirco Candeloro / Metanio, or are licensed to the Seller for distribution. They are protected under Italian law (Law No. 633/1941 on the Protection of Copyright), EU law, and applicable international copyright treaties, including the Berne Convention.
5.2 Licence Granted
Upon purchase, the Buyer is granted a personal, non-exclusive, non-transferable, non-sublicensable licence to:
Download and print the purchased file for personal, private, non-commercial use only;
Use the sheet music for personal study and private performance.
5.3 Prohibited Uses
The following are strictly prohibited without the prior written consent of the Seller:
Reproducing, copying, scanning, or redistributing the file in any format;
Sharing the file with any third party, whether for free or for payment;
Uploading the file to any website, platform, cloud service, or file-sharing system;
Using the sheet music for commercial performances, public broadcasts, recordings, or any revenue-generating activity;
Modifying, adapting, or creating derivative works from the content;
Removing or altering any copyright notices.
Violation of this licence constitutes copyright infringement and will be pursued under applicable law.
6. Pricing and Payment
All prices are displayed in Euros (€) and are inclusive of any applicable VAT where required by law.
Payment is processed securely through third-party payment providers. The Seller does not store payment card data.
The Seller reserves the right to modify prices at any time without prior notice. Price changes will not affect orders already completed.
7. Product Delivery
Digital products are delivered immediately or within a short time following successful payment confirmation.
The Buyer is responsible for ensuring their email address and download details are correct at the time of purchase.
If a download link expires or fails due to a technical error on the part of the Seller, the Buyer may contact us to request re-delivery. This does not constitute grounds for a refund.
8. Technical Requirements
The Buyer is solely responsible for ensuring they have the technical capability to access and use the Products, including:
A compatible device (computer, tablet, or smartphone);
A PDF reader or equivalent software;
A stable internet connection for downloading.
The Seller makes no warranty that the Products will be compatible with all devices or software.
9. Limitation of Liability
To the fullest extent permitted by applicable law:
The Seller's total liability to the Buyer shall not exceed the amount paid for the specific Product giving rise to the claim.
The Seller shall not be liable for any indirect, incidental, consequential, or special damages, including loss of data, loss of profits, or damage to devices.
The Seller is not liable for any failure to perform obligations due to causes beyond reasonable control (force majeure), including but not limited to internet outages, payment processor failures, or cyberattacks.
Nothing in these Terms limits liability for fraud, personal injury caused by negligence, or any other liability that cannot be excluded under mandatory applicable law.
10. Disclaimer of Warranties
Products are provided "as is." The Seller makes no warranties, express or implied, regarding:
The accuracy or completeness of the musical content;
The suitability of the sheet music for any particular purpose or skill level;
Uninterrupted or error-free access to the website or download links.
11. Privacy and Data Protection
The Seller processes personal data in accordance with EU Regulation 2016/679 (GDPR) and Italian data protection law. Personal data collected at checkout (name, email, payment information) is used solely for the purpose of processing and fulfilling your order. Please refer to our separate Privacy Policy for full details. By purchasing, you consent to such processing.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Italy. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Italian courts, specifically the court of the Seller's place of business, without prejudice to any mandatory consumer protection rights under the law of the Buyer's country of residence within the EU.
EU Buyers are also informed of the EU Online Dispute Resolution (ODR) platform, accessible at https://ec.europa.eu/consumers/odr, as an alternative dispute resolution mechanism.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable by a competent court, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
14. Amendments
The Seller reserves the right to update or modify these Terms at any time. Changes will be published on this page with an updated date. Continued use of the website following any changes constitutes acceptance of the revised Terms. It is the Buyer's responsibility to review these Terms periodically.
